1. Acceptance of Terms

By accessing or using JB Web Design’s services, you agree to comply with these Terms. If you do not agree, do not use our services.

2. Services Provided

We offer web design, hosting, maintenance, and marketing services. Specifics of each service are outlined in your contract or plan.

3. Client Responsibilities

Provide accurate information and timely access to resources. Maintain login confidentiality and notify us of security breaches.

4. Payments and Billing

Payments are due as per the selected plan. Late payments may result in service suspension. No refunds unless stated otherwise.

5. Intellectual Property

All content created by JB Web Design remains our property until payment is completed. Unauthorized use of our designs or code is prohibited.

6. Limitation of Liability

JB Web Design is not liable for indirect or consequential damages. Our liability is limited to the amount paid for services in the past 12 months.

7. Termination

Either party may terminate services with 30 days’ notice. Termination for breach may occur without notice.

8. Modifications

We reserve the right to update these terms with 30 days' notice.

10. A2P Messaging Compliance

10.1 Compliance with Regulations: By using our SMS messaging services, you agree to comply with all applicable laws, including but not limited to the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and other regulations governing A2P messaging.

10.2 Consent Requirements: You represent that you have obtained express written consent from recipients before sending any A2P messages. You are responsible for managing opt-ins and opt-outs in accordance with legal requirements.

10.3 Opt-Out Management: All A2P messages sent through our services must include an opt-out mechanism, such as “Reply STOP to unsubscribe.” You agree to honor opt-out requests promptly.

10.4 Message Content Restrictions: You agree not to send prohibited content, including but not limited to spam, deceptive offers, or illegal content.

10.5 Liability: You assume all liability for A2P messages sent through your account, including compliance with regulations and any penalties arising from non-compliance.
